Pesticide Residue updates to legislation

Chlorates

The European Commission is set to discuss proposals for MRLs for chlorate in foodstuffs at the next EU Standing Committee on Pesticide Residues (17-19 February). UK will be expected to adopt the agreed legislation during the Brexit transition period.

Also awaited is the clarification on the Drinking Water Directive.  The EU has notified the changes to be implemented from June 2020 allowing each member country to adopt the legislation over 2 years implying that the deadline would be after the Brexit transition deadline of 31st December.

MRL CHANGES FOR PROCLORAZ

Commission Regulation 2020/192, published 12th February 2020 amending MRLS for Procloraz in the following commodities of 4th September 2020.

The key MRLs to be removed are those that supported the post-harvest treatments of Citrus fruits, Mangoes and Pineapples and there is no transitional period for these commodities.

Mecoprop-P, the date is replaced by ‘31 January 2021’;
Pyraclostrobin, the date is replaced by ‘31 January 2021’;
Mancozeb, the date is replaced by ‘31 January 2021’;
Metiram, the date is replaced by ‘31 January 2021’;
Oxamyl, the date is replaced by ‘31 January 2021’;
Dimoxystrobin, the date is replaced by ‘31 January 2021’;
Flutolanil, the date is replaced by ‘28 February 2021’;
Benfluralin, the date is replaced by ‘28 February 2021’;
Fluazinam, the date is replaced by ‘28 February 2021’;
Mepiquat, the date is replaced by ‘28 February 2021’.

NON - APPROVALS

Non-Approval of Thiacloprid

Commission Regulation 2020/23 – Published 13th January 2020

Member States shall withdraw authorisations for plant protection products containing thiacloprid as active substance by 3 August 2020

Any grace period granted by Member States in accordance with Article 46 of Regulation (EC) No 1107/2009 shall expire by 3 February 2021.

Non-Renewal of Chlorpyrifos and Chlorpyrifos Methyl

Member States shall withdraw authorisations for plant protection products containing chlorpyrifos as an active substance by 16 February 2020

Any grace period granted by Member States in accordance with Article 46 of Regulation (EC) No 1107/2009 shall expire by 16 April 2020

MRL Reduction to be voted on 16/17th February 2020
